Frat house resident arrested on rape charges

UNM Police arrested a resident of the Sigma Alpha Epsilon fraternity house on charges of raping a minor.

Michael McGuffin, 24, was arrested Tuesday on 11 felony counts, including criminal sexual penetration, criminal sexual contact with a minor and sexual exploitation of children, said Lt. Pat Davis, UNM Police spokesman.

UNM has suspended the fraternity until the investigation is over, said Randy Boeglin, dean of students.

"We ought to reserve judgment until we know all the facts," he said.

Sigma Alpha Epsilon's national headquarters also suspended the chapter, Boeglin said.

Under the suspensions, the fraternity is not allowed to act as a social institution, he said.

It is still allowed to function as student housing, he said.

The following account is based on a search warrant and affidavit:

McGuffin has videos depicting sexual acts with a 15-year-old girl.

He also has a video depicting sexual acts with an unknown female who appeared to be unconscious and is believed to be a minor.

McGuffin has discussed the videos with other people.

Officers searched a bedroom in the Sigma Alpha Epsilon house belonging to McGuffin.

Police seized 21 items from McGuffin's room, including his cellular phone, computer, photographs, condoms and videotapes.

McGuffin admitted to UNM Police on June 9 that he was having a sexual relationship with the 15-year-old.

Matt Houston, president of the fraternity, declined to comment.

Last fall, a member of Sigma Alpha Epsilon, James Anaya, was arrested on charges of raping a female student at the fraternity's house.

The University did not discipline the fraternity when Anaya was arrested.

Correction: When it was first posted, this story had McGuffin's name misspelled and incorrectly identified him as a member of Sigma Alpha Epsilon.
