The headline for M. Lourdes Brito's letter in last Thursday's Daily Lobo should have said "Kiska's retirement comment illegal" rather than merely "petty."
What Mr. Kiska suggested to the Board of Regents at its committee meeting on Nov. 5 is not only offensive - it is also a violation of the federal Age Discrimination Act of 1975. That law forbids discrimination in employment against persons 40 and above, including mandatory retirement before age 70. Police and fire departments are among the few organizations allowed to impose mandatory retirement for reasons of public safety.
Were the regents to follow Mr. Kiska's suggestion, UNM could potentially be ineligible for federal grant and contract funds as well as federal financial aid for students.
Is trimming a little "moss" worth such a high cost to the University?
